By placing an order, you agree to the following terms and conditions and acknowledge that you have read all other relevant information:
Gertie Hall, otherwise stated as us, we, I, the seller.
You otherwise stated as the customer, the buyer, you.
- The Artist retains all rights to all artwork produced and is protected under the Copyright Act.
- The buyer acknowledges that every print is part of a limited edition as stated in the individual product information.
- The buyer acknowledges that under no circumstance may the artwork (print or digital) be reproduced, saved, or used for any purpose not outlined under Ownership.
- You acknowledge that the seller works with a third party to produce the prints for sale and therefore is at the mercy of the printer's turnaround times and shipping times. As such, these turnaround times will change from time to time and we will do our best to keep the website updated regularly, you acknowledge that any unforeseen minor delays are out of my control and that estimated turnaround times are purely estimates. No guarantee is made for the exact turnaround and shipping time.
Delivery:
- Standard production and delivery times are 2-4 weeks from the point of order (Australia) and up to 8 weeks (International).
- You acknowledge that these prints are made-to-order weekly and no express printing is available.
- You acknowledge that by selecting express postage, this applies exclusively to the postage. No express printing is available.
- All prints will be either sent in a tube or box with adequate protection at the discretion of the seller.
- Your order should be fulfilled by the estimated delivery date set out in the Dispatch Confirmation, unless there is an unforeseen event. If we are unable to meet the estimated delivery date because of an unforeseen event, we will contact you with an updated delivery date estimate.
- Delivery will be considered completed when the prints have been delivered to the shipping address given to us by you when ordering.
- If no one is available at the shipping address to take delivery it is up to the delivery partner’s discretion whether they attempt to redeliver. Otherwise, it will be up to you to collect from the post office/depot described on the delivery notice.
- The print(s) will be your responsibility once delivered.
- You are responsible for ensuring that the information (eg. address) provided is correct. We will not take any responsibility for orders not delivered due to the incorrect information being provided.
- You own the print(s) once we have received payment in full, including any delivery charges.
- You are responsible for inspecting the external packaging of the prints and marking any significant damage on the delivery confirmation receipt as required by the delivery partner as soon as you receive it.
- Any items/parcels which are significantly damaged must be rejected by you and returned to the delivery partner at the point of attempted delivery. You must immediately inform us of any delivery rejection in order that I can contact the delivery partner to resolve the situation.
- Should any damage be discovered at the point of delivery, you must provide photographs of the specific areas of concern along with the entire print and packaging, with the shipping label showing, to assist in our ability to raise a suitable claim with the delivery partner.
- Failure to inform us of any damage to the print(s) via email within 24 hours of the courier's delivery receipt will mean you have accepted the order in good condition or the condition it is in.
- I reserve the right to cancel any international orders should any unforeseen delays, shipping cost changes or anything arise.
Customer Responsibilities
- By purchasing a print, you are confirming that you have read the associated print description, information page and selected a size as required by you.
Ordering & Limited Editions
- All orders must be submitted via this website ("https://www.gertiehall.com"). No orders are taken via any other method.
- You are responsible for ensuring the completeness and accuracy of your order details and Gertie Hall will not be liable for any failure by you to provide complete and accurate information in your order.
- All print orders are for made-to-order fine art prints.
- Orders may only be deemed to have been accepted by us upon your receipt of our order confirmation via email, along with the relevant order reference number.
- We reserve the right to:
- Reject any order submitted by you for any reason.
- Cancel any order before delivery of the relevant print in the event any payment of the full order value fails.
- Without limitation to any provisions relating to Limitation of Liability, we will not be liable or otherwise responsible for any loss or damage caused to you by the cancellation of an order by us.
- The buyer acknowledges that they are purchasing a limited edition print as outlined in the product information.
- The buyer acknowledges edition sizes and quantities vary between prints.
- The seller agrees that no more editions than what is outlined in the product info will be printed.
- Each print will come with a signed and numbered Certificate of Authenticity.
- The buyer acknowledges that orders with multiple prints will be packaged and shipped together to the one shipping address. Orders required to be shipped to multiple addresses or packaged separately will be required to order them individually and pay the subsequent shipping fees. Large orders may be shipped in multiple packages.
- You acknowledge that these prints are made-to-order weekly and no express printing is available. Turnaround times are available here.
Payment
- All payments are taken securely through trusted third parties: Stripe or Paypal. No payments are excepted in any other form.
- I will not be liable for any issues that arise through these third-party payment providers.
Customs & Taxes
- At this time, this entity is not / does not require to be registered for GST. No GST is charged to the buyer.
- All local and international customs charges, duties and taxes are the responsibility of the buyer. I will accept no responsibility for any costs or delays that occur due to local or international customs, duties and taxes.
- It is the responsibility of the buyer to be informed of all relevant local and international customs charges, duties and taxes.
- If the buyer fails to pay customs charges, duties and taxes and subsequently the package is returned to sender, the order will be deemed complete and the buyer will not be entitled to any refund.
Returns
- All print orders are for on-demand, made-to-order fine art prints. As such, the right to cancellation under the Consumer Protection Regulations does not apply once the service of printing has been undertaken.
- Any order which has been damaged prior to delivery, where you have informed us within 24 hours of the delivery attempt (subject to the provisions in "Delivery"), will be exchanged or refunded upon its return and inspection.
- Any returns MUST include the corresponding certificate of authenticity. Returns will not be considered complete unless the certificate of authenticity is returned with the print.
- Any returns must still adhere to the care guide instructions (ie. rolling the print, print side facing outwards).
- All orders that are delivered and confirmed as undamaged, or where we have not been informed of any courier damage within 24 hours of delivery, are deemed to have been accepted by you in good condition and will no longer be replaced by us for free on return of the damaged item for disposal.
- Any damage caused after successful delivery is the responsibility of the customer.
- Damage caused during self-organised framing or mounting is the responsibility of the customer and no refund for prints that have been spoiled in this way.
- You acknowledge that third parties (ie. framers, payment providers) stated on "https://www.gertiehall.com" are in no way affiliated with Gertie Hall and no liability or responsibility is taken for the usage of these third parties. Please use your own discernment when working with third parties.
- All prints are quality checked before shipping, in the rare occasion that there is a major/noticeable fault that is missed prior to shipping, a refund will be offered upon its return and inspection by me and/or the printing partner.
Copyright and Ownership
- By purchasing a print from us, you understand that you own a copy of an original graphic artwork created by Gertie Hall.
- At no point do you, or will you, own the copyright of any artwork purchased from me.
- Prints may not be reproduced, copied, modified or shared digitally / electronically or used for any commercial or personal purposes without prior express permission and any applicable fee (as determined by me) being paid.
- It is illegal to produce copies of any work which is copyrighted by Gertie Hall, and I reserve the right to request legal assistance/compensation to enforce any applicable laws should any breach of copyright be discovered.
- The buyer agrees that by purchasing a print by Gertie Hall, it will be used for personal / office use only. Please get in contact for commercial commissions or branding associated artwork.
Privacy Policy
- No banking information is accessed or kept on file by me. All payments and bank account details are processed by third party operators.
- Only necessary personal information is stored via the Cargo & Stripe E-Commerce system for the use of order fulfilment.
- Your information will not under any circumstance be shared with any third party for marketing purposes.
- You will not be automatically subscribed to any marketing emails and will only receive correspondence via your outlined email regarding your order.
- You acknowledge that your shipping address and name may be disclosed with third parties for only shipping or drop shipping purposes.
- If you would like to discuss further how your information is stored and disclosed or would like to remove your personal information from databases please get in touch.
